Terms of Service

These Terms of Service (“Terms”) govern your use of the Nexalino platform at nexalino.com and any associated subdomains (the “Service”), operated by Job Search Global (ABN: 79 980 749 050) (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

Nexalino is an AI-powered website builder platform that enables users to create, edit, and publish professional websites. The Service includes AI content generation, a visual editor, form collection, lead management, subdomain hosting, and optional custom domain support.

2. Account Terms

  • You must be at least 18 years old to use the Service.
  • You must provide a valid email address and accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • One person or entity may not maintain more than one free account.

3. Acceptable Use

You agree not to use the Service to create, host, or distribute websites that:

  • Violate any applicable law or regulation
  • Contain or promote illegal content, including but not limited to child exploitation material
  • Promote hatred, violence, or discrimination against any individual or group
  • Contain malware, viruses, or other harmful code
  • Distribute spam, phishing attempts, or unsolicited commercial communications
  • Infringe on the intellectual property rights of others
  • Impersonate any person or entity, or misrepresent your affiliation
  • Collect personal information from visitors without proper disclosure
  • Engage in or promote fraudulent schemes
  • Contain pornographic or sexually explicit material
  • Interfere with or disrupt the Service or its infrastructure

We reserve the right to suspend or terminate any account that violates these terms, with or without notice.

4. Intellectual Property

Your Content

You retain ownership of all content you create or upload through the Service, including text, images, and site configurations. By using the Service, you grant us a limited licence to host, display, and deliver your content solely for the purpose of operating the Service.

AI-Generated Content

Content generated by our AI features is provided for your use. You are responsible for reviewing and ensuring the accuracy and appropriateness of all AI-generated content before publishing. We make no guarantees about the accuracy, completeness, or originality of AI-generated content.

Our Platform

The Service, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

5. Billing & Subscriptions

  • Free tier: We offer a free tier with limited features. Free sites remain accessible as long as your account is active.
  • Paid plans: Paid subscriptions are billed monthly or annually via Stripe. Prices are displayed at the time of purchase and may be updated with 30 days' notice.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
  • Refunds: We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@nexalino.com.
  • Downgrades: When a paid subscription expires or is cancelled, your site will continue to exist but paid features (such as custom domains and branding removal) will be disabled.

6. Site Publishing & Hosting

Sites created on the Service are hosted on subdomains of nexalino.com (e.g., your-site.nexalino.com). Paid plans may support custom domain connections. We reserve the right to take down any published site that violates these Terms or applicable law.

7. Termination

  • You may delete your account at any time through your account settings. Account deletion permanently removes your profile, sites, and associated data.
  • We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or fail to pay for a paid subscription.
  • Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

8. DMCA & Copyright Complaints

We respect intellectual property rights. If you believe content hosted on our platform infringes your copyright, please send a notice to support@nexalino.com including:

  1. A description of the copyrighted work you claim has been infringed
  2. The URL of the infringing content on our platform
  3. Your contact information (name, email, phone)
  4. A statement that you have a good faith belief the use is not authorised
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
  6. Your physical or electronic signature

We will respond to valid notices in accordance with applicable law and may remove or disable access to the infringing content.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content may contain inaccuracies. You use the Service at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or AUD $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
